Abstract

Digital transformation has significantly reshaped the provision of legal services, including the exercise of notarial functions by public officials authorized to execute authentic deeds. These developments have not been fully accommodated by Indonesia's legal framework, resulting in regulatory gaps concerning the validity of electronic authentic deeds, electronic identity verification, digital signatures, personal data protection, and professional oversight. This study aims to examine the weaknesses of the current regulatory framework governing notarial digitalization in Indonesia and to formulate a regulatory strengthening model that supports a professional, accountable, and legally certain notarial system. This research employs normative legal research using statutory, conceptual, and comparative approaches. Legal materials were collected through library research consisting of legislation, legal doctrines, and relevant scholarly publications and were analyzed qualitatively using a prescriptive legal analysis. The findings reveal that the existing regulatory framework remains fragmented due to normative inconsistencies between the Law on Notarial Office and regulations governing electronic information and transactions, personal data protection, and electronic evidence. Regulatory reform should focus on harmonizing legislation, establishing legal standards for electronic identity verification, certified electronic signatures, digital archival systems, digital professional ethics, and technology-based supervisory mechanisms. The novelty of this research lies in proposing an integrated regulatory reconstruction model for notarial digitalization that combines professionalism, accountability, personal data protection, professional supervision, and legal certainty within a comprehensive legal framework capable of responding to technological developments and the evolving needs of legal services..
